End User License Agreement (EULA)

1. Installation and use

This software is distributed as shareware and is available in two versions. The free trial version is limited to two categories of 20 recipes each. This restriction can be lifted by purchasing the full version for a fee.

The trial version may be used on any number of computers. The license for a full version allows the licensee to install the software on a single PC system.

2. Backup copies

Private copies of the software may be made for archiving and backup purposes.

3. Disclosure/publication/resale

The distribution of the RezeptSuite trial version is expressly permitted and encouraged. Only the complete installation package may be distributed to third parties. The distribution of the personal full version is not permitted, as the license is tied to the licensee. Accordingly, the resale of the personal license is also prohibited.

4. Compliance with applicable laws

You agree to comply with all applicable laws and regulations regarding the downloading, installation, and/or use of the software.

5. Termination

The license may be revoked by the licensor if you violate its terms. In this case, you are obliged to destroy all copies of the software in your possession.

If you download the full version of the RezeptSuite software from our online shop, your right of withdrawal for this product expires if, before the contract is executed, you expressly agree to the execution of the contract before the withdrawal period expires by clicking the “Buy now” button during the ordering process “Buy now” button during the ordering process that the contract will be executed before the end of the withdrawal period and at the same time acknowledge that your right of withdrawal expires when the contract is executed. You will be notified of this again separately at the appropriate point in the ordering process. We will also note this in the confirmation email that you will receive from us after the contract has been concluded.

6. Copyright

All property rights and industrial property rights to the software are held by the manufacturer of the software. All ownership rights and industrial property rights to content that is not included in the software product but can be accessed using the software product are held by the respective content owner and may be protected by applicable copyright laws and other laws and agreements relating to intellectual property. This EULA does not grant you any rights to use such content.

7. Warranty

Any liability for material defects or defects of title, as well as any warranty, whether express or implied, in particular for fitness for a particular purpose and/or freedom from defects, is excluded.

8. Liability

With the exception of liability for damages resulting from injury to life, limb, or health caused by negligent or intentional breach of duty, further claims by the licensee—regardless of the legal basis—are excluded, unless expressly agreed otherwise. The licensor is therefore not liable for damages that did not occur directly to the delivery item; in particular, it is not liable for lost profits or other financial losses of the licensee. The above exemption from liability does not apply if the damage is based on intent, gross negligence, or the absence of a warranted characteristic, breach of essential contractual obligations, delay in performance, impossibility, or claims under Sections 1 and 4 of the Product Liability Act. The manufacturer of the software is not liable for the restoration of data unless we have caused the loss intentionally or through gross negligence and the licensee has ensured that a data backup has been made so that the data can be reconstructed with reasonable effort.

9. Severability clause

This agreement constitutes the complete terms and conditions for the use of RezeptSuite. It takes precedence over all other written or verbal agreements. If any provision of this agreement is void, invalid, or unenforceable, the remaining provisions shall remain in full force and effect.

10. Eigene Inhalte und Rezeptimport

Nutzer können Rezepte und Bilder selbst eingeben oder den Import von einer angegebenen Internetadresse ausdrücklich anstoßen. Der Import ändert nichts an Rechten Dritter. Nutzer dürfen nur Inhalte speichern, vervielfältigen oder teilen, soweit sie hierzu berechtigt sind, und müssen Quellenangaben erhalten. RezeptSuite macht sich diese Inhalte nicht zu eigen und wertet sie nicht redaktionell aus.

11. Private Rezeptfreigabe

Die Funktion „Teilen“ erzeugt einen nicht öffentlichen, zufälligen Link, der standardmäßig 14 Tage gültig ist und vom Nutzer jederzeit beendet werden kann. Der Link ist nur für eine gezielt ausgewählte Person und den persönlichen Gebrauch bestimmt; er darf nicht öffentlich veröffentlicht oder weiterverbreitet werden. Der Nutzer bleibt für die geteilten Texte und Bilder sowie die erforderlichen Rechte verantwortlich.

12. Nutzungsrecht zur technischen Bereitstellung

Für die Dauer der Speicherung und einer aktiven privaten Freigabe räumt der Nutzer RezeptSuite das einfache, räumlich auf die technische Leistungserbringung beschränkte Recht ein, die von ihm eingestellten Inhalte zu speichern, technisch zu vervielfältigen und dem Empfänger des privaten Links zugänglich zu machen. Dieses Recht endet mit Löschung des Inhalts beziehungsweise Beendigung der Freigabe, soweit keine gesetzlichen Aufbewahrungspflichten entgegenstehen.

13. Meldung und Sperrung rechtswidriger Inhalte

Mögliche Rechtsverletzungen können direkt auf der Freigabeseite oder per E-Mail an rezeptsuite@rezeptsuite.de gemeldet werden. Bitte bezeichnen Sie den betroffenen Inhalt, das verletzte Recht und Ihre Berechtigung nachvollziehbar. Gemeldete Freigaben können bis zur Prüfung sofort gesperrt und bei einer bestätigten Rechtsverletzung dauerhaft entfernt werden. Missbräuchliche Meldungen sind unzulässig.
